A small percentage of total exports and reexports require a license from the U.S. Department of Commerce or the U.S. State Department. As the exporter, you must determine whether or not your items require an export license based upon the goods’ technical characteristics, the destination, the end user and the end use. Failure to obtain a required export license can result in significant fines, restrictions on future exports, and—in the most egregious cases—jail time.
In this whitepaper, you'll learn:
  • What is an export: Did you know that an item sent by regular mail or hand-carried on an airplane is an export? Software uploaded or downloaded from an internet site or technology transferred via email are also considered exports for control purposes.
  • Who has jurisdiction over your goods: While most items fall under the jurisdiction of the Commerce Department, some items are controlled by the State Department or other government agencies. Export compliance begins by understanding which agency has jurisdiction.
  • How to determine if you need a license: Learn how to find the Export Control Classification Number (ECCN) for the item you’re exporting, if it has one, and how to cross reference an ECCN with the Commerce Country Chart. Certain individuals and organizations are restricted from receiving U.S. exports—learn what lists you need to check to be sure you’re not exporting to a restricted party.
  • How to proceed when your items need or don’t need a license: Learn the fastest and best way to apply for a license if you need one and where to look for more information on licenses.
